Traditions provide a structure to the society. They are rigid in nature. Thus they impede change.
Provides identity to society. Thus, doesn't change with changing times easily.
People cling on to their traditions to earmark themselves as different from others.
Traditions help society to maintain its distinctive character. People are averse to changing traditions because they think change will lead to loss of social identity.
Thus, many traditions like tattooing in Naga culture, piercing back with metal rod to make texture in
African culture. Distinctive piercing and face tattoos - Maori tribe - New Zealand persist.
But many negative traditions like child marriage, Nikah halala, female genital mutilation, dowry etc. also persist in name of tradition.
Effectiveness of social legislation:
Social legislations like Dowry Prohibition Act, Child Marriage (Prohibition) Act, etc. has helped women a lot.
Protection of Civil Rights Act was instrumental in stopping untouchability. Prevention of Atrocities Against SC/ST Act was also effective.
Maharashtra law against witchcraft and social boycott are also
greater examples.
But laws have their limitation, like law against manual scavenging has not been very successful.
Similarly, there is a need to create enabling infrastructure, provide for economic rehabilitation etc.
Social legislation can be the first step. But concentrated effort from civil society organisations and social dialogue via a people's movement is the most important step. Eg: The recent debate about UCC shows the confluence of modernity and tradition.
